1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you ("Client") and SwiftBookPro ("Provider," "we," "us," or "our"), concerning your access to and use of the SwiftBookPro.app website and the AI receptionist services (collectively, the "Service").

2. Description of Service

SwiftBookPro provides an AI-powered receptionist service designed for HVAC and service businesses. The Service includes call answering, message taking, appointment scheduling, and call routing based on configurations set by the Client. The Service utilizes third-party providers for telephony (Twilio) and payments (Stripe).

3. User Obligations

By using the Service, you represent and warrant that:

  • You have the legal capacity and you agree to comply with these Terms.
  • You are not a minor in the jurisdiction in which you reside.
  • You will not access the Service through automated or non-human means, whether through a bot, script, or otherwise.
  • You will not use the Service for any illegal or unauthorized purpose.
  • Your use of the Service will not violate any applicable law or regulation, including telecommunications regulations and anti-spam laws (e.g., TCPA).

4. Payments and Billing

Services are billed on a subscription basis. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.

We use Stripe as our third-party payment processor. By using our Service, you agree to be bound by Stripe's Services Agreement.

5. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

6. Limitation of Liability

In no event shall SwiftBookPro, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
